The Pilates BEAT Terms & Conditions, Liability Waiver and Refund Policies

DEFINITIONS

The “Studio” refers to The Pilates BEAT studios. This “website” refers to www.thepilatesbeat.com is owned and operated by The Pilates BEAT. “Service” refers to any service or information provided by The Pilates BEAT either online, on our website, in the studios or provided as part of a course or event. “Client” refers to any person using the services provided by The Pilates BEAT.

Please read these terms and conditions carefully. You must NOT use this website, the studio or any of the services if you do not agree to be bound by the terms that are outlined below. 

TERMS & CONDITIONS

The classes provided by The Pilates BEAT are operated on a first come, first served basis. Should a class become full, a waitlist is created. 

Program fees and class fees are subject to change at any stage. A minimum of 14 days will be given prior to price change. Access to online content is available until the end of the billing period, unless a breach of the terms and conditions occurs.

All classes must be booked and paid for in advance. We operate a 12 hour cancellation policy. If you cancel within 12 hours of the class commencing, you are charged in full. If you do not attend a class or are late for a class, your pass will be forfeited. 

Doors are locked once classes commence and no entry is allowed after 5 minutes of the class start-time. This is for your own health and safety as the warm-up will have commenced, and also for the consideration of the class Instructor and Clients. If you arrive at the studio more than 5 minutes late, you will not be allowed to enter.

Participants between 16-18 years of age are required to have written consent from a parent/guardian to attend classes. No entry for those under 16 years of age.

We require a minimum of 3 Clients per class. If there are less than 3 booked in for a class, it may be cancelled or a shorter session may be provided. We aim to run all classes, however, if a class is cancelled for any reason, we aim to notify those who are booked in as soon as possible and your class pass will not be used. 

Instructors may change for various reasons and we do our best to let you know in advance of classes.

Each class purchase has an expiry date to expire from a certain period after first use. Please pay special attention to the expiry of your purchase. New client packs and offers are only valid for new clients only and are only valid for 31 days. There is a 31 day expiry on all monthly class packs.

Photographs and videos may be taken during classes to be used for marketing purposes.

REFUND POLICY

We are unable to offer a refund policy. Classes are non-refundable. However, under certain circumstances and a refund is issued, this will not include a €50 administration charge. 

LIABILITY STATEMENT

The Services provided by thepilatesbeat.com/The Pilates BEAT are not a substitute for personal or professional medical care and diagnosis. Before undertaking any programs (exercise/pilates/meditation), or following advice from thepilatesbeat.com/The Pilates BEAT, you are required to undertake a full medical assessment and obtain clearance from your physician or health care provider. It is your own responsibility to obtain medical clearance and be deemed fit and well to participate. We are not responsible for the same. The Pilates BEAT instructors are not issuing medical advice or acting in place of medical professionals, therefore the information and programs from this website and within classes should be taken as guidance only. If medical clearance is not obtained prior to commencing a program or following advice from thepilatesbeat.com/The Pilates BEAT, you are doing so at your own risk. You are aware that with all exercise there are risks, especially when carried out in an unsafely manner or with incorrect form. Any persons with pre-existing or current injuries, illnesses or medical conditions should not partake in any of the services provided by thepilatesbeat.com/The Pilates BEAT. Risks may also exist for those who are currently in good health. It is your responsibility to ensure you are only attending classes of suitable level for your current health and ability.

The management of thepilatesbeat.com/The Pilates BEAT reserves the right to close the website without notice for as short a period of time as is necessary in the circumstances should the proper maintenance and upkeep of the website be required.

Should any Client, in the reasonable opinion of The Pilates BEAT, cause any nuisance or annoyance to other Clients or staff or behave in a way deemed inappropriate to the wellbeing of thepilatesbeat.com/The Pilates BEAT, then that member may be refused services. The decision of the management of thepilatesbeat.com/The Pilates BEAT in this regard shall be considered as final. Clients join thepilatesbeat.com/The Pilates BEAT and use its services and information at their own risk. Albeit that thepilatesbeat.com/The Pilates BEAT does not seek to limit its liability in respect of death or personal injury to members caused by the negligence of the website or its instructors, it is nevertheless recommended that all members if they are in any doubt whatsoever should seek medical advice from their own doctor before embarking on any fitness class or program recommended by thepialtesbeat.com/The Pilates BEAT. It is to be completely understood that The Pilates BEAT, thepilatesbeat.com are not responsible for any illnesses, injuries or health problems that you may experience as a result of any products, services or information provided by thepilatesbeat.com/The Pilates BEAT. 

We aim to provide correct and accurate information on our website. It is your responsibility to provide us with accurate and correct information and inform us of any changes of the same. We do not accept any liability for your omission or error in providing us with information. We do not accept any liability for any action you, your heirs or your legal representatives may take following loss or injury suffered as a result of following information provided on this website or through our services online or in-person.

If you bring any personal belongings to the Studio, you are doing so at your own risk and we do not accept any responsibility for loss, damage or theft.

Results of any form are not guaranteed from any Service issued by thepilatesbeat.com/The Pilates BEAT. The results you obtain will be determined by your effort and consistency with the exercises provided.

You, your heirs and legal representatives release waive, discharge and covenant not to sue The Pilates BEAT and/or its instructors for any injury or death caused by their negligence or other acts.
